Crown Castle – Why Are They Calling?

Crown Castle International Corp, d/b/a Crown Castle, is an American corporation that is the largest cell tower owner/developer, owning/operating over 40,000 cell towers in North America and providing coverage to 98 of the top 100 markets.

Crown Castle-New Cell Tower Lease: Crown Castle has approached you to possibly allow a cell tower or other wireless equipment on their property. Property owners need to first establish what their bargaining power is in this transaction.Crown Castle-Lease Buyout Request: Crown Castle is looking to buy out existing cell tower leases and has made a dedicated effort to contact property owners to offer them this buyout option. Crown Castle will typically structure a lease buyout as a simple, one-time payment for both assigning a property owner’s remaining rights under the lease and also converting the current lease to a long-term or perpetual easement. The motivation for Crown Castle is mostly driven by the need of that company to secure time it requires at the site.

Crown Castle-Tower Lease Extension: Crown Castle, like many similar cell tower companies, is aggressively seeking out long-term extensions to their current cell tower leases. Crown Castle proposes to extend their ground leases for 30 or more years. Crown Castle usually wants to get the lease term extension for a nominal signing bonus and/or a small increase in rent. The decision a landowner makes today as it relates to an extension of its current lease may mean hundreds of thousands of dollars over the life of is lease, as a few hundred dollars more a month means a lot when paid over 10, 20 or more years. This is an important transaction and should not be taken lightly.

Crown Castle-Lease Expansions/Consents: Crown Castle is often looking to expand their leased area at a tower site or obtain certain consent rights to allow them to handle additional tenants and ultimately generate more revenue. A property owner should understand what is truly being asked of him or her, including: (1) How much area is being requested, and does the tenant really need all of that area, or are they getting extra space for future expansion as well? ; (2) What is going to be the true impact of any consent given to your property now and into the future? ; (3) What is the “true value” of the space or consent that is being requested? ; and (4) Do you have the opportunity to not only increase rent but get a better overall lease?
